I think you are on the right path. Non-revenue sports, title IX and the equal protection clause will severely limit what the P5 can do.
Also, with the level of tv revenue and coach's compensation the non-profit status of FB (contribution deductions) may be in jeopardy
at the P5 level.
Saban's and Calipari's salaries should be enough to kill the educational exemption from taxation as well. Tax their TV revenue!
