I’m no lawyer but I think Ark State might have a pretty good case especially after all the offers of other reasonable dates. If Miami was smart, they’d settle before trial.

My instinct was to be pro Ark State in this, but I was reserving judgement till FW spoke because I figured he'd have a thoughtful argument to complicate matters. Instead we got a response that was the equivalent of a red herring and facebook cliche rolled into one.

FW is yogwf royalty and deserves to be. I've never met him but I like him and wish him every happiness. But on the subject of his only favorite college football team he might as well be posting on the Rant. Two summers ago my daughter had a signed contract with a music festival in Methow Valley in Washington state. Massive fires not only canceled the festival but the venue itself was burned down. Unbidden and out of the blue she received a smaller check “for her troubles” because they said they understood that she had committed to them and had turned down other offers for the time period. They didn’t have to do anything and could rightfully have claimed force majeur. This year when they asked her to come back she gladly accepted because they were so honorable the first time.
Do the right thing and the rest will follow.

When were they supposed to play? Neither team had a similar open date to reschedule the game. Miami played the rest of the season without a bye week. FSU made up a game during championship weekend. Miami played in the ACC championship game, so that weekend wasn't an option. What gerryb and windy said. Hurricanes/floods/fires/locusts happen. But if you still can’t or won’t reschedule within a reasonable period—6 years seems more than a reasonable timeframe—then you write a check. A check that is probably in the rounding errors for The U but really means something for the little guys.
The longer this goes on, the more I hope Ark State gets compensated and then some. I also hope rent-a-win schools put some serious teeth in their game contracts with the football factories. And I couldn’t find Ark State on a map.

When 'Bama didn't play their return game with us in NOLA, didn't they arrange for BYU to come in and play us instead? Did they write us a check for the difference? You would think that UM would come up with a more creative solution than "$crew you."

It was clear that Miami didn't want to play this game, and was sorry they had scheduled it. The hurricane gave them an entirely justifiable out. And, honestly, they were right to cancel, even if they had wanted to play the game. FW is also correct that there was no good time to reschedule it this year.
But all of that is entirely besides the point and not even relevant.
Talking about the hurricane and why it was ok to cancel and why it couldn't be made up, is like talking about apples when debating oranges. This isn't about that. At all.

Prof, are you literally saying Miami was afraid of playing Arky State? If so, I will never take one of your posts seriously again. Miami was in playoff contention until the ACC Title game, but, ok. As for future games, this game was scheduled when Al Golden was coach. Mark Richt has said he isn't going to, and would never schedule an away game against a Sun Belt level opponent, so no, he's not going to reschedule this game 6 years in the future. I'm sure Miami knows what they're doing "risking" a lawsuit.

But they didn't want to play it. They didn't want to travel to the middle of nowhere to play a road game against a nobody. And I don't blame them. No other AD would have signed this deal to begin with.
And they had a good out (the hurricane).
But they did still sign the deal. And if Ark State wants it made up, then so be it. Miami needs to play the game. Or pay up. Or make some other deal like Bama did for Tulane. But not try to hide behind a hurricane that has literally NOTHING to do with this problem. Well, they went to Boone in 2016 and beat a better App State team 45-10. But, no, Richt does not want to go to Jonesboro, when they're scheduling games against Florida in Orlando, LSU in Dallas, Alabama in Atlanta, Michigan State in East Lansing, Texas A&M in College State, etc.
